Then, in walks your final candidate. She has a pierced eyebrow with a rather large ring and another stud on her bottom lip.<\/p>\n<p>Otherwise, she is dressed professionally. She is articulate and appears to be self-confident. Best of all she has an excellent education and relevant job experience. Yet you hesitate. Why?<\/p>\n<p>Because this is a conservative organization. Although there\u2019s a strict dress code, it fails to list specific rules on an individual\u2019s hair, tattoos makeup and piercings. She also seems to have a tattoo on her wrist.\u00a0 Is this a valid concern? The answer is yes and \u2026 also no.<\/p>\n<p>&nbsp;<\/p>\n<p>Confused yet? I don\u2019t blame you. These types of decisions have become much more common and relevant in today\u2019s workforce. Lawyers, doctors, nurses, accountants and government workers do not always conform to traditional appearances in their personal lives. Yet people frequently modify their appearances for what some may describe as \u2018outdated\u2019 expectations within the work sphere. Suddenly that cute little rose tattoo on your wrist (or maybe it\u2019s that \u201csleeve\u201d tattoo) is cause for not getting hired. Even though you are qualified. Is this discrimination?<\/p>\n<p>&nbsp;<\/p>\n<div id=\"attachment_6318\" style=\"width: 301px\" class=\"wp-caption alignright\"><a href=\"https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2017\/01\/hiring.workopolis.com-sleeve-tattoo.jpg\"><img decoding=\"async\" aria-describedby=\"caption-attachment-6318\" class=\"wp-image-6318 \" src=\"https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2017\/01\/hiring.workopolis.com-sleeve-tattoo.jpg\" alt=\"Sleeve tattoo at interview\" width=\"291\" height=\"224\" \/><\/a><p id=\"caption-attachment-6318\" class=\"wp-caption-text\">Is a sleeve tattoo still a big deal?<\/p><\/div>\n<h2><span style=\"font-size: 12pt;\"><strong>Can an Employer Prohibit Tattoos and Piercings? <\/strong><\/span><\/h2>\n<p><strong>\u00a0<\/strong>According to Canadian Labour Lawyer <a href=\"http:\/\/www.mondaq.com\/canada\/x\/460616\/employee+rights+labour+relations\/Can+An+Employer+Prohibit+Tattoos+And+Piercings\">Peter McLellan<\/a><\/p>\n<ul>\n<li>An employer can (legally) choose not to hire someone based on any (visible) tattoos or piercings.<\/li>\n<li>Often, there is no violation of the <em>Human Rights Act.<\/em><\/li>\n<li>The <em>Charter of Rights and Freedoms<\/em>\u00a0does not apply in this particular situation unless the piercings or tattoos are part of an ethnic or tribal custom.<\/li>\n<li>Since this preference or dress code is legal, it follows that the employment ads can clearly state that no applicants with visible tattoos or piercings will be considered. With that said, the saying \u201c<em>just because you can <\/em>doesn\u2019t<em> mean you should<\/em>\u201d is timely.\n<p><div id=\"attachment_6316\" style=\"width: 210px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2017\/01\/eyebrow-piercings-fresh-face.jpg\"><img decoding=\"async\" aria-describedby=\"caption-attachment-6316\" class=\"wp-image-6316 size-medium\" src=\"https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2017\/01\/eyebrow-piercings-fresh-face-200x300.jpg\" alt=\"Eyebrow piercings and tattoo at work\" width=\"200\" height=\"300\" srcset=\"https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2017\/01\/eyebrow-piercings-fresh-face-200x300.jpg 200w, https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2017\/01\/eyebrow-piercings-fresh-face.jpg 564w\" sizes=\"(max-width: 200px) 100vw, 200px\" \/><\/a><p id=\"caption-attachment-6316\" class=\"wp-caption-text\">A different type of eyebrow piercing<\/p><\/div><\/li>\n<\/ul>\n<h2><span style=\"font-size: 12pt;\"><strong>It\u2019s up to \u201cthe employer\u201d to make the decision to hire someone who doesn\u2019t exactly look the part but is perfect for the job. If it&#8217;s just a tattoo, h<\/strong><strong>ow do you decide?<\/strong><\/span><\/h2>\n<ul>\n<li>Consider <strong><em>bona fide occupational requirements<\/em><\/strong> <strong>(BFORs)<\/strong>. According to Wikipedia, in Canada, a BFOR \u201cis a quality or an attribute that employers are allowed to consider when making decisions on the hiring\u00a0and retention of employee. Further, it is\u00a0a quality that when considered in other contexts would constitute\u00a0discrimination\u00a0and thus be in violation of civil rights employment law. Such qualifications must be listed in the employment offer.\u201d<\/li>\n<li>Today the presence of certain tattoos and piercings doesn&#8217;t mean the same as they did years ago.<\/li>\n<li>Is it time to evolve? Maybe yes? Maybe no?<\/li>\n<li>Stop and think about whether a person\u2019s style is really that important to get the job done.<\/li>\n<li>Do they interact with the public? Your clients?<\/li>\n<li>Is it possible that someone tattooed and\/or pierced could actually attract a new, broader demographic or fresh image for the business?<\/li>\n<li>Plus, let&#8217;s face it, some work environments are still very conservative while others are much more relaxed<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>There\u2019s more to consider on this topic.
