The decriminalization of medicinal and recreational cannabis\/marijuana has been a long-fought battle. Now that it\u2019s legal, one outstanding issue that continues to raise concerns is how it can affect the workplace. Will this significantly alter an employee\u2019s motivation, productivity\/performance, attention to detail, or overall professionalism? Will vaping cannabis at lunch become the new cigarette break or replace the proverbial boozy lunch?<\/p>\n<p>From an HR perspective, I think it\u2019s imperative to address those cannabis concerns and re-evaluate the stereotypes that some people have about cannabis users. It\u2019s possible that many of us think of people who \u2018use\u2019 cannabis as being similar to what we see on TV, and not the reality we live in.\u00a0 For starters, it&#8217;s likely that many coworkers, superiors and other professionals are already habitually using some form of marijuana in their day-to-day life. In April 2018, <a href=\"https:\/\/www150.statcan.gc.ca\/n1\/en\/daily-quotidien\/180418\/dq180418b-eng.pdf?st=BZzhbsJn\" target=\"_blank\" rel=\"noopener noreferrer\">Statistics Canada<\/a> reported that 4.2 million or 14% of Canadians over 15 years old had used medical or recreational cannabis in the past three months. Further, 56% said that they used some form of cannabis weekly or daily. For the sake of (an imperfect) comparison, in 2017 the World Health Organization reported that\u00a0Canadians aged 15 and older drank 10 litres of pure alcohol per capita in 2016. &#8220;Despite the known and potentially hazardous effects on human health, alcohol has remained a commonly consumed beverage worldwide. In Canada, approximately 19.5 percent of consumers were\u00a0<a href=\"https:\/\/www.statista.com\/statistics\/439899\/share-of-canadians-heavy-drinkers\/\" target=\"_blank\" rel=\"noopener noreferrer\">reported as heavy alcoholic drinkers<\/a>\u00a0in 2017, with men consuming five or more drinks per sitting and women consuming four or more drinks, at least once per month for 12 months.&#8221;<\/p>\n<p>There have been numerous pop culture films where pot smoking was the main theme, such as the classic Cheech and Chong, which is about two nomadic guys lost in a haze of smoke as they smoke themselves into an epically lawless adventure. Similarly, the movie Dazed and Confused captures the 1970\u2019s nostalgia of being a teenage hippie in suburbia. And most notably, comedian Dave Chappelle\u2019s breakthrough claim to fame was based on his role in, Half Baked, a portrayal of aimless &#8216;<a href=\"https:\/\/www.google.ca\/search?q=what+is+a+stoner&amp;rlz=1C1CHBF_enCA763CA763&amp;oq=what+is+a+stoner&amp;aqs=chrome..69i57j0l5.5311j0j7&amp;sourceid=chrome&amp;ie=UTF-8\" target=\"_blank\" rel=\"noopener noreferrer\">stoners<\/a>&#8216; selling weed to help pay for a friend\u2019s jail bond.<\/p>\n<div id=\"attachment_8974\" style=\"width: 532px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/10\/cannabis_workplace-Conference-Board.jpg\"><img decoding=\"async\" aria-describedby=\"caption-attachment-8974\" class=\"wp-image-8974\" src=\"https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/10\/cannabis_workplace-Conference-Board-1024x536.jpg\" alt=\"Cannabis policy in Canada\" width=\"522\" height=\"273\" srcset=\"https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/10\/cannabis_workplace-Conference-Board-1024x536.jpg 1024w, https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/10\/cannabis_workplace-Conference-Board-300x157.jpg 300w, https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/10\/cannabis_workplace-Conference-Board-768x402.jpg 768w, https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/10\/cannabis_workplace-Conference-Board-1080x565.jpg 1080w, https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/10\/cannabis_workplace-Conference-Board.jpg 1200w\" sizes=\"(max-width: 522px) 100vw, 522px\" \/><\/a><p id=\"caption-attachment-8974\" class=\"wp-caption-text\">See the full report at www.conferenceboard.ca\/cannabis<\/p><\/div>\n<p>When looking to these popular movies as a guide it\u2019s easy to stereotype cannabis users as immature, directionless, or even irresponsible. \u00a0From there, it\u2019s not surprising that some people are shocked and apprehensive about the legalization of a substance that in many countries is still associated with criminal behaviour. At the very least marijuana has gotten a bad wrap for making users act and appear lethargic, unmotivated, disorganized and forgetful. When we juxtapose employees with any of these stoner characters from the big screen then, of course, there&#8217;s a reason for concern.<\/p>\n<p>In reality, however, the dopey, red-eyed, \u2018pothead\u2019 isn\u2019t always a fair representation of a person who uses cannabis. The stigma towards those who choose to light up (or nowadays discreetly vape, or consume edibles) for recreational or medicinal reasons is starting to diminish. So, let\u2019s start to address some of the lingering concerns that many of us have about how marijuana will affect the workplace.<\/p>\n<p>&nbsp;<\/p>\n<h2><span style=\"font-size: 12pt;\"><strong><em>The blunt facts about cannabis and work <\/em><\/strong><\/span><\/h2>\n<p>Whether we agree or disagree about the legalization of cannabis it&#8217;s now the law of the land and the change is literally in the air. Employers need to be prepared to deal with the \u2018plume\u2019 of questions and the essential rules to follow in this new climate.<\/p>\n<h3><span style=\"font-size: 12pt;\"><strong>1) There are two popular types of cannabis that are being consumed:<\/strong><\/span><\/h3>\n<ul>\n<li><strong>CBD<\/strong> is often prescribed for medical uses<\/li>\n<li><strong>THC<\/strong> is more common for recreational use<\/li>\n<li>For more information, here\u2019s an <a href=\"https:\/\/www.healthline.com\/health\/cbd-vs-thc\" target=\"_blank\" rel=\"noopener noreferrer\">article<\/a> that explains the differences between the two in more detail<\/li>\n<\/ul>\n<h3><span style=\"font-size: 12pt;\"><strong>2) For Ontario residents, this website on <a href=\"https:\/\/www.ontario.ca\/page\/cannabis-legalization\">Cannabis legalization<\/a> is a good resource:<\/strong><\/span><\/h3>\n<p><a href=\"https:\/\/www.ontario.ca\/page\/cannabis-legalization\" target=\"_blank\" rel=\"noopener noreferrer\">Cannabis Legalization<\/a> (Ontario)<\/p>\n<h3><span style=\"font-size: 12pt;\"><strong>3) Issues related to Employment Law:<\/strong><\/span><\/h3>\n<p>There are several issues that relate to employees, workplace roles and responsibilities. I\u2019ll address two here.<\/p>\n<p><span style=\"font-size: 12pt;\"><strong>A &#8211; <\/strong><strong>Employees\u2019 Rights While Working in Unlicensed Cannabis Dispensaries<\/strong><\/span><\/p>\n<p>Although many cannabis dispensaries are operating,\u00a0<a href=\"https:\/\/www.thestar.com\/news\/gta\/2017\/02\/22\/pot-dispensary-workers-question-what-legal-rights-they-have.html\" target=\"_blank\" rel=\"noopener noreferrer\">only a small portion of them<\/a>\u00a0are legal and licensed by Health Canada.<\/p>\n<p>Workers at these unlicensed dispensaries have questioned what legal rights they have while <em>their<\/em> sale of cannabis remains illegal.
