By now, you\u2019ve probably heard about the low oil prices in Alberta and the ripple effect that it\u2019s having on those businesses, employees, and the economy. Similarly, you may have seen the headlines about the upcoming GM plant closure in Oshawa, ON, a suburb of Toronto. 100 years of car manufacturing as the foundation of the Oshawa economy will end in 2019. This news is causing considerable angst, particularly among employees who are in the later stages of their careers but not quite ready to retire (<em>watch this short <a href=\"https:\/\/ottawa.ctvnews.ca\/video?clipId=1549297&amp;binId=1.1164511&amp;playlistId=1.4192291&amp;fbclid=IwAR2ySNTFW4fA__Av51ytLLaw8oiTqVNo1q8q3zmX-5TAoCb4pYgdFup22iY\" target=\"_blank\" rel=\"noopener noreferrer\">video<\/a> from CTV News<\/em>). Sometimes I have clients come to me <em>after<\/em> already receiving outplacement from another company. Typically, those clients come to me because they need something above and beyond access to online documents and access to watching videos. Although those resources were helpful it wasn\u2019t enough to help them figure out which jobs to pursue and how to actually update their own cover letters and resumes. Likewise, the online documentation wasn\u2019t quite helpful enough to prepare carefully for interviews.<\/p>\n<h2><span style=\"font-size: 12pt;\"><strong>Career Change Resources for Experienced\/Mature Employees Facing Lay-off<\/strong><\/span><\/h2>\n<p>Because of the recent headlines, I have created a <a href=\"https:\/\/ioadvisory.com\/blog\/career-change-resources-mature-employees\/\" target=\"_blank\" rel=\"noopener noreferrer\">Career Change Resources for Experienced or Mature Employees<\/a> webpage that includes links to available Ontario government resources and blog articles.<\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/12\/ScreenShot-CFRA-Dec2-2018.jpg\"><img decoding=\"async\" class=\"alignleft wp-image-9160\" src=\"https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/12\/ScreenShot-CFRA-Dec2-2018-1024x549.jpg\" alt=\"\" width=\"444\" height=\"238\" srcset=\"https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/12\/ScreenShot-CFRA-Dec2-2018-1024x549.jpg 1024w, https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/12\/ScreenShot-CFRA-Dec2-2018-300x161.jpg 300w, https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/12\/ScreenShot-CFRA-Dec2-2018-768x412.jpg 768w, https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/12\/ScreenShot-CFRA-Dec2-2018-1080x579.jpg 1080w, https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/12\/ScreenShot-CFRA-Dec2-2018.jpg 1408w\" sizes=\"(max-width: 444px) 100vw, 444px\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>On December 2, 2018 I was invited to do a live interview on CFRA Ottawa, with\u00a0Dahlia Kurtz on\u00a0<strong>\u2018The Goods with Dahlia Kurtz\u2019<\/strong>, discussing the\u00a0<strong>Challenges of Finding a Job When You\u2019re a More Mature and Experienced Employee (e.g., an employee at the GM Oshawa plant, or one of GM\u2019s suppliers)<\/strong>.<\/p>\n<audio class=\"wp-audio-shortcode\" id=\"audio-9168-1\" preload=\"none\" style=\"width: 100%;\" controls=\"controls\"><source type=\"audio\/mpeg\" src=\"https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/12\/dr-helen-ofosu-CFRA-Dec2-2019.mp3?_=1\" \/><a href=\"https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/12\/dr-helen-ofosu-CFRA-Dec2-2019.mp3\">https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/12\/dr-helen-ofosu-CFRA-Dec2-2019.mp3<\/a><\/audio>\n<h2><\/h2>\n<h2><span style=\"font-size: 12pt;\"><strong>Are Employees Facing Lay-off Entitled to Financial Compensation? <\/strong><\/span><\/h2>\n<p>In Ontario, when someone loses their job through no fault of their own, they are entitled to <a href=\"https:\/\/www.ontario.ca\/document\/your-guide-employment-standards-act\/severance-pay\" target=\"_blank\" rel=\"noopener noreferrer\">severance pay<\/a> and\/or <a href=\"https:\/\/www.ontario.ca\/document\/your-guide-employment-standards-act-0\/termination-employment\" target=\"_blank\" rel=\"noopener noreferrer\">termination pay<\/a> (the rules may differ somewhat in other jurisdictions). In the case of the employees at GM in Oshawa, since they are getting approximately 12 months notice, their access to termination pay may be significantly reduced. This means that they probably should not wait for a large payout, rather they should probably be searching for alternative employment before their current jobs end. Some organizations will offer access to outplacement services since employees who find alternative employment should cost the organization less in terms of severance and\/or termination pay.<\/p>\n<p>I would recommend that employees facing job loss should check with an employment\/labour lawyer, or if they are unionized, they should check with their union.<\/p>\n<h2><span style=\"font-size: 12pt;\"><strong>Factors that may Determine Eligibility for Severance \/ Termination Pay<\/strong><\/span><\/h2>\n<p><a href=\"https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/12\/mari-helin-38313-unsplash.jpg\"><img decoding=\"async\" class=\"alignright wp-image-9173\" src=\"https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/12\/mari-helin-38313-unsplash-300x200.jpg\" alt=\"outplacement may be covered, check the fine print in your contract\" width=\"338\" height=\"225\" srcset=\"https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/12\/mari-helin-38313-unsplash-300x200.jpg 300w, https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/12\/mari-helin-38313-unsplash-768x512.jpg 768w, https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/12\/mari-helin-38313-unsplash-1024x682.jpg 1024w, https:\/\/ioadvisory.com\/blog\/wp-content\/uploads\/2018\/12\/mari-helin-38313-unsplash-1080x720.jpg 1080w\" sizes=\"(max-width: 338px) 100vw, 338px\" \/><\/a>If there\u2019s a chance that you or someone you know may be entitled to some form of severance and\/or termination pay, the following points are worth thinking about.<\/p>\n<ul>\n<li>reasonable notice of employment termination is determined on a case-by-case basis, this means that two people in a similar role may be eligible for different levels of compensation<\/li>\n<li>there is no \u2018cap\u2019 on what is considered adequate or reasonable notice of the termination of employment (in some cases 12 to 24 months)<\/li>\n<li>the issues considered when establishing reasonable notice include: (a) the nature or character of the employment, (b) the employee\u2019s age, (c) the length of time that the employee has worked for the employer, (d) the availability of similar alternative employment that is aligned with the employee\u2019s experience, qualifications, and training. Taken together, \u2018reasonable notice\u2019 refers to the amount of time it will likely take the terminated employee to find comparable employment.
